The people have the right to clean air, pure water, and to the preservation of the natural, scenic, historic and esthetic values of the environment. Pennsylvania’s public natural resources are the common property of all of the people, including generations to come. As trustee of these resources, the Commonwealth shall conserve and maintain them for the benefit of all of the people.

This is a starting point for legal action. The Courts have not been very reasonable in making the above clearly stated constitutional provision a reality. That is purely a political perspective. The Courts come under the same pressure from industry and lobbying groups as does the legislative body. Once the body politic (us) demands that Article I, Section 27 be interpreted as written to protect all people and not just developers, the Courts will alter their skewed interpretations.

This is a legal tool that should be used. Let the lawsuits begin!
